The Health Security se National Security Cess Act, 2025 imposes a new cess on the manufacture of certain “sin goods” like Pan Masala to fund public health and national security.
The Health Security se National Security Cess Act, 20251 proposes to levy a cess on the production of goods such as Pan Masala and any other goods that may be notified by the central government. Proceeds from the cess will be used for expenditure towards public health and national security2.
What Does It Mean
The Act introduces a cess on sin goods such as Pan Masala, with proceeds earmarked for health security and national security expenditures. The cess is payable by any person who owns or controls manufacturing machines or undertakes specified manufacturing processes for these goods.
The levy is calculated on a per-machine basis or per unit of manual production and is collected on a monthly basis3. To ensure compliance, designated officers not below the rank of Commissioner are empowered to conduct audits to verify the correctness of cess payments. In cases of non-payment or discrepancies, authorities may initiate proceedings for the recovery of cess, along with applicable interest and penalties4.
After the cessation of the GST compensation cess, the taxation structure is reorganised: tobacco and related products will attract GST in addition to excise duty, while Pan Masala will attract GST plus the Health Security se National Security Cess5.
Now enacted into law, the legislation goes beyond a mere technical tax amendment. It forms part of a broader, rule-based framework6 to secure stable and predictable revenues. The Act clearly defines liability, valuation, and payment obligations, and lays down a sequential compliance pathway—from registration and declaration of machines or processes, to monthly payment and returns, followed by scrutiny, enforcement, and appellate mechanisms.
By establishing a structured compliance regime7 and a predictable revenue stream, the Act seeks to support targeted spending on health and national security, while also functioning as a behavioural deterrent against the consumption of harmful products.
